1. About StayLink

StayLink Inc. ("StayLink", "we", "us", or "our") is a Delaware corporation that operates an online marketplace connecting content creators with hotels, boutique properties, and unique accommodations ("Properties"). Our platform enables creators to discover and apply for collaboration opportunities, and enables Properties to find and work with creators who tell their story.

StayLink is a platform intermediary only. We do not own, operate, or manage any Property listed on the platform, and we are not a party to any collaboration agreement between a Creator and a Property.

2. Eligibility and Accounts

You must be at least 18 years of age to use StayLink. By creating an account, you represent that all information you provide is accurate, current, and complete, and that you will maintain and promptly update this information.

You are responsible for safeguarding your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized access or use of your account.

We reserve the right to suspend or terminate accounts that violate these Terms or that we determine, in our sole discretion, to be harmful to the platform or its users.

3. Creator Accounts

Creator accounts are free. As a Creator, you may create a profile, list your social media accounts and portfolio, post upcoming travel dates, browse open invitations from Properties, and apply for collaboration opportunities.

You represent that your profile, portfolio, and social media statistics are accurate and not misleading. Submitting false follower counts, fabricated engagement metrics, or content you do not own is grounds for immediate account termination.

Any collaboration agreement (including the scope of deliverables, timing, and compensation) is made directly between you and the Property. StayLink is not responsible for the performance of either party under that agreement.

4. Property Accounts

Property accounts are available on a subscription basis at $99 USD per property per month. By subscribing, you authorize us to charge your payment method on a recurring monthly basis until you cancel.

You represent that you are an authorized representative of the Property you list, and that the information in your listing is accurate. You agree not to list properties you do not own or manage, or to misrepresent the type or quality of the property.

You may cancel your subscription at any time. Cancellations take effect at the end of the current billing period; no partial-month refunds are issued unless required by law.

5. Content and Intellectual Property

You retain ownership of all content you submit to StayLink, including profile information, portfolio items, photos, and messages. By submitting content, you grant StayLink a non-exclusive, worldwide, royalty-free license to display, reproduce, and distribute that content solely for the purpose of operating and promoting the platform.

You are solely responsible for ensuring that your content does not infringe the intellectual property rights of any third party, and that you have obtained all necessary permissions to share it on StayLink.

The StayLink name, logo, and platform design are the exclusive property of StayLink Inc. and may not be used without our prior written consent.

6. Prohibited Conduct

You agree not to:

• Post false, misleading, or fraudulent information about yourself or your property
• Harass, threaten, or discriminate against any user
• Use the platform to solicit users to transact outside of StayLink in order to circumvent fees or platform terms
• Scrape, crawl, or otherwise extract data from the platform by automated means
• Introduce malware, viruses, or any other harmful code to the platform
• Impersonate any person or entity, or falsely claim an affiliation with any person or entity
• Use the platform for any unlawful purpose or in violation of any applicable law or regulation

7. Reviews and Reputation

After a completed collaboration, both Creators and Properties may leave reviews. Reviews must be honest and based on genuine experience. StayLink reserves the right to remove reviews that are fraudulent, defamatory, or otherwise in violation of these Terms.

Attempting to manipulate your own rating or that of another user — through fake reviews, threats, or incentivization — is prohibited and may result in account suspension.

8. Disclaimers

StayLink is provided "as is" and "as available" without warranty of any kind. We do not warrant that the platform will be uninterrupted, error-free, or free of harmful components.

We do not verify the identity of all users, guarantee the quality of any Property, or guarantee that a Creator will deliver agreed-upon content. Any reliance you place on information presented on the platform is at your own risk.

9. Limitation of Liability

To the fullest extent permitted by law, StayLink Inc., its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, or goodwill — arising out of or in connection with your use of the platform or any collaboration facilitated through it.

Our total aggregate liability for any claim arising under these Terms shall not exceed the greater of (a) $100 USD or (b) the amounts paid by you to StayLink in the three months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless StayLink Inc. and its affiliates, officers, and employees from any claim, loss, liability, or expense (including reasonable attorney's fees) arising from your use of the platform, your content, your violation of these Terms, or your violation of any third-party right.

11. Governing Law and Disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any dispute arising from or relating to these Terms or your use of StayLink shall be resolved exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts.

Before filing any legal action, you agree to first contact us at hello@staylinkapp.com to attempt to resolve the dispute informally.

12. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page and, for material changes, notify you by email or via an in-app notice. Your continued use of StayLink after changes take effect constitutes your acceptance of the revised Terms.
